Can anyone tell me what paperwork I need to fill out when starting a business. It will be a sole proprietorship. I know I need a tax ID number... what other state/county paperwork do I need to make everything legal?

depends on what type of business, how its structured (sole propietorship you already answered, partnership, or corporation), whether or not you'll have a storefront, etc. Let us know a few more details such as industry, and whether or not you'll have a storefront, warehouse, etc.

www.myflorida.com will have all the forms and info you need.

it's a bit of a bitch to navigate, but mainly an occupation permit and tax id, for a non-incorporated business. if you work out of your home, occupational permits are still needed, and cheap as shit.

your Tax ID number in a sole proprietrship is your SSN. You just need a business license to operate within the county/city I believe. Research it on Google.

well after 3-4 hours of researching I came up with needed a sellers permit and businesss license ... and thats it

0 employees - home based business (no storefront) ... now to find a good accountant in orlando

Good luck with your business and I hope it does well.

1) you need to obtain a business liscense; you can do this by going throw www.sunbiz.org, there is a small fee to setup but you can do it online or just call them up

2) Once you have your business registered and have all your information, then you need to register your tax ID number. You can do this through the IRS www.irs.gov, or call them as well

3) If you are looking for financing or loans or just general information use www.sba.gov; this is your new best friend with all the information you will ever need.

Also, you can use www.myflorida.com, that is a great resource too......
With steps 1 and 2 done, you can register a bank account in your business name. I recommend Wachovia or Bank of America. They work with ADP, which is a payroll company that can really help you grow yourself. I went with Wachovia because they have a great Small business package........

first off, from a small business owner: wachovia sucks ass. really, really bad. and BoA is expensive, especially for a startup.

no, you do not need to register with the irs until you pull out of debt and start payroll checks. be sure to file with the florida department of revenue though, http://www.myflorida.com/dor/.

Check with your local tax collector's office (city or state, depending on where you are... if you call, they'll tell you) and ask about an occupational permit.




or, you can go to myflorida or readup. sunbiz isnt bad either, but limited.

since when? ive attempted both (and had wachovia), and neither had free business checking. personal, yes. business, no.

and no, you DONT need an EIN, if you have a ficticious name, they use your SSN. Trust me, ive done this.

1) Wachovia and BoA both have plans where you get 250 free transactions a month, You can look it up online or visit your nearest branch for more info.....

2) When you register a sole proprietorship, your EIN number is your SS#, When you own a corporation, this number is given to you by the state.

for 1- i just got info back from BoA, and they said no... I havent looked online. I dont care to look at wachovia, like i said, they're a real shitty bank, and they gave me more problems in 6 months than ive had with any bank in my lifetime.

2- you dont need to 'register a sole proprietorship'. ficticious name filing works just fine.

the only reason i keep this going is to help him and whoevers reading it.


there is a HUGE difference between registering a sole proprietorship and a ficticious name. a ficticious name can be registered for more than just businesses. any orginization can register for one, not just business. having that alone doesn't register your business, just your chosen orginizational name. you must register with your ficticious name (assuming you need to register, if you're working under your legal name, there are other provisions), as well as your pertinant information to the county and FDOR to officially be in business as a sole proprietorship.

GTE Federal Credit Union does my business banking. They have a $500 minimum and beyond that no fees. In every category they were better than Wachovia... not sure about BoA but I imagine since GTE FCU is non-profit and BoA is for-profit those profits come from somewhere and it's fees. Do check to see if there is a fine for seeing a human, in a lot of banks there is such a creature.

If you arn't going to have a place where employees go to do work I would skip the business license as that is one way they find you for tangibles tax. Tangibles tax is something businesses pay on tangible items such as chairs, computer, and other crap.. Very small amount but it will make your CPA lots of money tracking it.

You can use your SSN however I would recommend getting an EIN from the IRS for identity theft reasons. You can get a fictitious name for about $50 or register a LLC for about $120(I think.. It's been a while)... I would recommend the LLC as it gives you some measure of liability protection.

Keep in mind if your register to collect sales tax(DR-1) you need to file every quarter even if it's $0.00 ... Failing to file is a $50 fine... So don't bother until you actually need it. Is a "Resale Certificate" what you meant by "Seller's Permit"? This process grants you a resale certificate which means you can buy stuff without paying sales tax on it(so you charge it when you resell at a higher price)

Single member LLC is by default a disregarded entity for IRS purposes.. In other words you file your taxes as a sole prop.
