Will the Fact that John McCain wasnt born in the US ( he was born in the Panama Canal Zone because his father was in the Military) make his win (if he wins) the presidentcy Null and void due to the Native Natural Born Citizen provision to become President.
This is never been an issue before, but does anyone else think the Dems could use this trick against the GOP is McCain actually wins??

i'm fairly certain that since the panama canal was owned by the US at the time that makes him native born. it's not an issue.

With that theory, people from Puerto Rico and Guam can run for President. Case law says other wise.

I believe that McCain was born on a military base, which is considered American soil.

He was born on a base, which is considered a US territory. The provision is strict in the fact it has to be a state. I don't think it matters, but this could be the new "hanging chad ".

No, a US military or diplomatic installation overseas is considered US soil. He is a US citizen no different if he was born within the territorial boundaries of the 50 states.

It's all in the term "natural born citizen" in the constitution... really intresting stuff. you could argue both ways.

I hear what you're saying Aaron. After having a president actually argue the definition "is" then absolutely someone could argue McCain's citizen qualifications for President.
I just love lawyers.

The problem Tokin is that the constitution says " natural Born citizen" . Anyone born on a base is technically "naturalized" . It's all in the legalise. There is very little case law on the subject because it wasn't an issuse.

well look at it the other way. if he's not an american citizen then what was his citizenship prior to that. ie was he ever considered a citizen of another country?as in the country the base he was in? if a lawyer can show he was, then u might have a point. Otherwise, he's a natural born us citizen.

See thats the thing TECHNICALLY he's a NATURALIZED citizen on the books.. Natural born means BORN in the US based upon several pieces of case law. Not that it means anything to me , but if Billary loses to McCain , I can see this as an issue.
