Why should his cell company eat up a portion of the bill that has been generated due to 3rd party services?

Because, they aren't going to take him to court, they may drop it or they may compromise. You are the customer. If a bank notices odd things about your account they contact you. So should the cell companies. Otherwise its' obvious they are trying to squeeze money out of you. Do you think they should notice something to be odd if your cell bill went from $30 a month to $7,000? No, it wouldn't hold up in court.
